Terms of use

These terms govern your use of codscale.co, the CodScale dashboard, storefront funnels, APIs, and related services (the "Service"). By creating an account or using the Service you agree to them on behalf of yourself and the organization you represent.

1. Early-access phase

CodScale is currently in a trial phase. The Service is provided free of charge while we complete the platform with our first merchants. Features may change, be added, or be removed. We will announce paid plans and AI credit pricing before the trial phase ends, with reasonable notice, and your data will remain available to you.

2. Accounts and organizations

  • You must provide accurate information and keep your credentials confidential. You are responsible for activity under your account.
  • An organization is created by its owner and reviewed by CodScale before activation. We may accept, reject, or restrict organizations to protect the platform and other merchants.
  • Team members, confirmation agents, warehouse agents, and follow-up agents act under the organization that invited them. The organization is responsible for their use of the Service.
  • You must be at least 18 years old and legally able to run a business in your jurisdiction.

3. Acceptable use

You agree not to:

  • Sell counterfeit, illegal, or prohibited goods, or goods that violate the policies of the channels and carriers you connect.
  • Contact customers who have not agreed to be contacted, or send messages that violate WhatsApp, Meta, TikTok, or telecom rules.
  • Send false, misleading, or manipulated events to advertising platforms.
  • Upload malware, scrape the Service, probe its security, or interfere with other organizations' data.
  • Use AI features to generate unlawful, deceptive, or harmful content.
  • Resell or sublicense the Service without a written agreement with CodScale.

4. Your data and your customers

You own the business and customer data you upload. You grant CodScale a licence to host, process, and transmit it as needed to run the Service and the integrations you enable. You are the controller of your customers' data and are responsible for collecting it lawfully, for the notices on your storefront funnels, and for how you use confirmation calls, WhatsApp messages, and ad tracking. Our Privacy policy describes how we process data on your behalf.

5. Storefront funnels and tracking

Funnels are published under your brand and domain. You are responsible for their content, prices, offers, delivery terms, and legal notices. When you enable tracking, CodScale sends the events you configure (including server-side Purchase events at creation, confirmation, or delivery) to the ad platforms you connect. You must have the right to send that data and comply with each platform's terms.

6. AI features

AI confirmation, follow-up, marketing, creative, and assistant features produce outputs automatically from your data and instructions. Outputs can be inaccurate. Review them before relying on them, and configure fallbacks (such as handing off to a human agent) appropriately. You are responsible for messages and content sent to customers under your brand. AI usage may be limited by credits or fair-use thresholds that we publish in the dashboard.

7. Third-party integrations

Carriers, sales channels, ad platforms, messaging providers, and payment services are operated by third parties under their own terms and fees. CodScale is not responsible for their availability, pricing, delivery performance, settlement timing, or policy decisions. Connecting a platform authorizes CodScale to exchange data with it on your behalf.

8. Fees and payments

During the trial phase the Service is free. Any future fees will be shown before you subscribe, invoiced in the currency stated, and may include platform subscriptions and AI credits. Carrier fees, ad spend, telecom charges, and taxes are yours to pay directly to those providers or authorities.

9. Availability and support

We aim for high availability but do not guarantee uninterrupted service during the trial phase. We may perform maintenance, roll out features gradually, or suspend access to investigate abuse. Support is available at support@codscale.co and by WhatsApp during business hours.

10. Intellectual property

CodScale, its software, design, documentation, and brand are owned by CodScale and its licensors. You receive a limited, revocable, non-exclusive right to use the Service for your business. Feedback you give us may be used to improve the product without obligation to you.

11. Termination

You may close your organization at any time. We may suspend or terminate access for breach of these terms, legal risk, non-payment once fees apply, or prolonged inactivity, with notice where practical. After termination you can export your data for 30 days, after which it is deleted as described in the Privacy policy.

12. Disclaimers and liability

The Service is provided "as is" during the trial phase. To the extent permitted by law, CodScale disclaims implied warranties and is not liable for indirect losses, lost profits, lost orders, failed deliveries, ad platform decisions, or data loss caused by third parties. Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim, or, during the free trial, to 100 000 DZD.

13. Governing law

These terms are governed by the laws of Algeria. Disputes are submitted to the competent courts of Algiers, unless mandatory law in your country gives you other rights.

14. Changes to these terms

We may update these terms as the platform and pricing evolve. Material changes are announced in the dashboard or by email at least 15 days before they take effect. Continued use after that date means you accept the new terms.
